Proceedings on 5.04.24 in Hon High Court Delhi pertaining to WP( C) 4946 filed by DOT praying for setting aside of Judgment of PB CAT ND, dated 20th Sept, 23.

The captioned matters were listed yesterday i.e. 05.04.2024 as Item No. 36 & 38 (along with the connected matter at item no. 37) before Hon’ble Justice Rekha Palli and Hon’ble Justice Sudhir Kumar Jain at the Delhi High Court. 

When the matter was called out, the counsel appearing for the Union of India sought an accommodation and adjournment for one month since they had to engage the Ld. ASG. On this, the bench expressed displeasure as to why was this aspect not informed before since the bench had taken time out to read the matter. The bench indicated that it was inclined to impose costs since so much time of the court has been wasted if the intention was only to seek an adjournment, but refrained from doing so since a young counsel was appearing for the Union.

The court was informed that the matter pertained to pensioners and that the writ petition had been filed belatedly after a period of 8 months. 

However since an adjournment was sought, the Bench adjourned the matter to 12.07.2024 for hearing and made it clear that no notice was issued and no stay had been granted by the High court and therefore the Tribunal may proceed further with any proceedings.

As advised, we must prepare for a contempt petition at the earliest. My colleague Aditi will be sharing the drafts and affidavits with you shortly.
