Supreme Court criticizes BSNL Management for unnecessarily filing court cases — orders BSNL Management to pay Rs.1 lakh as the cost.
BSNL Management is wasting a lot of money in filing court cases, to deny benefits to the deserving employees. In one such case, the Supreme Court of India has severely criticised the BSNL Management and has ordered BSNL to pay Rs.1 lakh as the cost, for unnecessarily filing an appeal against the High Court order, in the matter of giving Compassionate Ground Appointment to a deserving candidate. Importantly, the Supreme Court has told the BSNL Management that, the amount could be recovered from the officer who wrongly advised to file the appeal in the Supreme Court. The details of the case are as follows. The Madhya Pradesh circle administration of BSNL wrongly denied Compassionate Ground appointment to a candidate. The candidate filed a case in the CAT and got a favourable judgement. However, the Management filed an appeal in the High Court of Madhya Pradesh against the CAT order. The Madhya Pradesh High Court also gave an order in favour of the candidate. Against this order of the Madhya Pradesh High Court, BSNL Management filed an appeal in the Supreme Court. Refusing to interfere with the CAT judgement, the Supreme Court has criticised the BSNL Management. The Supreme Court observed that, a government-owned company like BSNL was not expected to file a case against the granting of Compassionate Ground Appointment to the legal heir of an employee who died in harness.
